A BASIC INTRODUCTION TO EMPLOYMENT AND LABOR LAW IN TEXAS
Texas is an at-will state. This means that an employer may generally terminate any employee for any reason, good reason, bad reason, or no reason at all. The legal argument for this wide latitude given to employers is that employees are free to quit at any time, with or without reason. However, employers may not fire an employee on the basis of race, religion, national origin, gender, sexual orientation, or on the basis that an employee made a worker’s compensation claim.
Retaliation claims by employees can arise when an employee reports workplace discrimination to the employer and is subsequently fired or demoted as a result of the reporting.
